      Die konkrete Bedeutung des Begriffs der «schweren psychischen Störung» als juristischer Anknüpfungstatbestand ist Gegenstand zahlreicher Kontroversen. Dieser Artikel zeigt auf, dass der Begriff sinnvollerweise nicht automatisch mit einer Diagnose nach ICD-10 oder DSM-5 gleichzusetzen ist. Die genannten Klassifikationssysteme wurden für allgemeinpsychiatrische Bedürfnisse geschaffen und haben schon mit Blick auf ihre Konzeptualisierung nur wenig mit der forensisch-psychiatrischen Logik gemein. Analog zur militärspezifischen Richtlinie für die Beurteilung der Diensttauglichkeit von Stellungspflichtigen und Armeeangehörigen, der «nosologia militaris», wird für die Forensik die Orientierung an einem Modell postuliert, das die spezifischen Bedürfnisse der Forensik abdeckt.

      Prospektive Untersuchungen von Opfern sexueller Übergriffe und retro-spektive Untersuchungen an Straftäterpopulationen weisen auf einen Zusammen-hang zwischen sexuellen Missbrauchserfahrungen in der Kindheit (SMK) und Delin-quenz im Erwachsenenalter hin. Methode: Ziel vorliegender Arbeit war es, an einer repräsentativen Stichprobe von Gewalt- und Sexualstraftätern aus dem Kanton Zürich (Schweiz; N=354) der Frage nachzugehen, was Straftäter mit SMK-Erfahrungen charakterisiert. Es wurden zwei multivariable Modelle für SMK gebildet. Ergebnisse: Bei 13% der Sexualstraftäter und bei 5.8% der Gewaltstraftäter war SMK dokumentiert. Mit 18.9% wiesen Kindsmissbraucher die höchste SMK-Prävalenz auf. Multivariable Analysen identifizierten die einheimische Bürgerschaft, Heimaufenthalte und Gewalt in der Primärfamilie als Prädiktoren mit dem höchsten Erklärungswert für SMK. In einem zweiten Modell wurden nur Merkmale aus dem Erwachsenenalter des Täters berücksichtigt. Folgende Prädiktoren erhöhten das Risiko, zur Gruppe der Täter mit SMK zu gehören, signifikant: Verurteilung wegen Kindsmissbrauchs, eigene Prostitution und einschlägige Vorstrafen mit Gewalt- bzw. Sexualdelikten. Diskussion: Die Ergebnisse legen die Vermutung nahe, dass SMK zu einem erhöhten und chronifizierten Risiko für eigene Kindsmissbrauchstäterschaft führen.

      Für Straftäter konnte wiederholt eine hohe Prävalenz belastender Lebenserfahrungen aufgezeigt werden. Nur wenige Untersuchungen gingen bisher der Frage nach, ob und in welchen Fällen das eigene Delikt für Straftäter ein traumatisches Ereignis darstellen kann. Methode: Die Behandlungsakten von 82 männlichen Gewalt- und Sexualstraftätern, die im Kanton Zürich in deliktorientierter Behandlung waren, wurden ausgewertet. 35 der Therapieklienten erklärten sich für eine persönliche Untersuchung bereit. Ergebnisse: Acht der 35 Gewalt- und Sexualstraftäter benannten ihr Delikt als belastendstes Erlebnis. Nur bei einem der acht Straftäter konnte die Diagnose einer PTBS gestellt werden. Diskussion: Deliktorientierte forensisch-psychologische Behandlungsprogramme setzen die Auseinandersetzungsfähigkeit mit dem Delikt voraus. Bei Straftätern, die durch das eigene Delikt belastet oder traumatisiert wurden, ist von einem Vermeidungsverhalten auszugehen, das die Bearbeitung des Deliktverhaltens deutlich erschwert und somit den Erfolg von aufwändigen deliktorientierten Behandlungsprogrammen gefährdet.

      The penal code in Switzerland is strongly oriented toward the prevention of crime. Hence, most cases involving severe acts of violence trigger a psychiatric expert opinion that contains a section on risk-assessment. The threshold for court-ordered treatment is low and follows a rather pragmatic approach: On the basis of a psychiatric expert opinion, the court can order a specific therapeutic or confinement measure. Treatment can be ordered regardless of criminal responsibility. The court’s decision depends upon the determined risk for reoffending and whether there are treatment strategies available to reduce this risk. In most cases, the courts rule that the treatment be performed in an outpatient setting, following a period of treatment while incarcerated, during a suspended sentence or period of probation, or even while awaiting sentencing.

      Durch forensisch-psychiatrische Begutachtungen von Straftätern können Beurteilungen der Schuldfähigkeit und des Rückfallrisikos vorgenommen sowie Empfehlungen über sinnvoll erscheinende Massnahmen zur Deliktprävention (z.B. anzuordnende Therapien oder sichernde Massnahmen) gemacht werden. Gerade bei gefährlichen, rückfallgefährdeten Gewalt- und Sexualstraftätern kommt der Begutachtung eine besondere Bedeutung zu. Studien aus Deutschland haben aber ergeben, dass deutlich weniger als die Hälfte der Gewalt- und Sexualstraftäter begutachtet wurden. Diejenigen, die einer Begutachtung zugeführt wurden, wurden in der Regel als voll schuldfähig eingeschätzt. Da in Deutschland von Gesetztes wegen keine Einschätzung des Rückfallrisikos bei schuldfähigen Straftätern vorgesehen ist, kann davon ausgegangen werden, dass eine forensisch-psychiatrische Legalprognose nur bei einer kleinen Minderheit von Gewalt- und Sexualstraftätern erfolgt. Im Vergleich zu Deutschland ist in der Schweiz der Präventionsaspekt in der Justizvollzugspraxis stärker ausgeprägt. Der Gutachter ist angehalten eine Risikobeurteilung vorzunehmen und sich zur Indikation rückfallsenkender therapeutischer oder sichernder Massnahmen zu äussern. Das Ziel der vorliegenden Studie bestand in der Prüfung der Hypothese, dass in der Schweiz die Begutachtungsquote bei Gewalt- und Sexualstraftätern höher als in Deutschland ist. Es konnte gezeigt werden, dass Gewalt- und Sexualstraftäter im Kanton Zürich erheblich häufiger als in verschiedenen deutschen Bundesländern zum Urteilszeitpunkt begutachtet und hinsichtlich ihrer Gefährlichkeit und ihres Interventionsbedarfs durch einen Experten beurteilt werden.

      In past years, the female offender population has grown, leading to an increased interest in the characteristics of female offenders. The aim of this study was to assess the prevalence of female violent offending in a Swiss offender population and to compare possible socio-demographic and offense-related gender differences. Methods: Descriptive and bivariate logistic regression analyses were performed for a representative sample of N=203 violent offenders convicted in Zurich, Switzerland. Results: 7.9% (N=16) of the sample were female. Significant gender differences were found: Female offenders were more likely to be married, less educated, have suffered from adverse childhood constellations and to be in poor mental health. Female violent offending was less heterogeneous than male violent offending, in fact there were only three types of violent offenses females were convicted for in our sample: One third were convicted of murder, one third for arson and only one woman was convicted of a sex offense. Conclusions: The results of our study point toward a gender-specific theory of female offending, as well as toward the importance of developing models for explaining female criminal behavior, which need to be implemented in treatment plans and intervention strategies regarding female offenders.

      here is an ongoing debate on whether consumers of child pornography pose a risk for hands-on sex offenses. Up until now, there have been very few studies which have analyzed the association between the consumption of child pornography and the subsequent perpetration of hands-on sex offenses. The aim of this study was to examine the recidivism rates for hands-on and hands-off sex offenses in a sample of child pornography users using a 6 year follow-up design. Methods: The current study population consisted of 231 men, who were subsequently charged with consumption of illegal pornographic material after being detected by a special operation against Internet child pornography, conducted by the Swiss police in 2002. Criminal history, as well as recidivism, was assessed using the criminal records from 2008. Results: 4.8% (n=11) of the study sample had a prior conviction for a sexual and/or violent offense, 1% (n=2) for a hands-on sex offense, involving child sexual abuse, 3.3% (n=8) for a hands-off sex offense and one for a nonsexual violent offense. When applying a broad definition of recidivism, which included ongoing investigations, charges and convictions, 3% (n=7) of the study sample recidivated with a violent and/or sex offense, 3.9% (n=9) with a hands-off sex offense and 0.8% (n=2) with a hands-on sex offense. Conclusions: Consuming child pornography alone is not a risk factor for committing hands-on sex offenses – at least not for those subjects who had never committed a hands-on sex offense. The majority of the investigated consumers had no previous convictions for hands-on sex offenses. For those offenders, the prognosis for hands-on sex offenses, as well as for recidivism with child pornography, is favorable. Zum Artikel

      Various studies have repeatedly shown an increased prevalence for Posttraumatic Stress Disorder (PTSD) in delinquents when compared with the general population. Lifetime prevalence varies between 33% and 36%, and point prevalence between 17% and 21%. The aim of this study was to examine whether these findings are applicable to offenders detained in Switzerland. Method: The sample consisted of 86 offenders. In order to control for over-reporting of traumatic life events three sub-samples (remand, sentenced/inpatient and sentenced/outpatient) administered by the Office of Corrections of the Canton of Zurich were examined. PTSD was diagnosed using the Posttraumatic Diagnostic Scale (PDS), a self-rating instrument for diagnosing PTSD according to the Diagnostic and Statistical Manual of Mental Disorders, Version IV (DSM-IV). Results: Point prevalence of PTSD was conservatively estimated at 27%. The three sub-samples did not differ in the prevalence of PTSD when adjusted for potential demographic differences. Seventy-five percent of the subjects had experienced at least one traumatic event that matched the criteria for a traumatic event according to the DSMIV. The Median number of traumatising life events according to the PDS was four in the examined sample. Conclusion: In this sample of male prisoners in Switzerland the prevalence of current PTSD was comparable to other international studies.       Investigations in different countries suggest the prevalence of childhood sexual abuse in men ranges between 5% and 16%, but studies of offender populations have found a relatively higher lifetime prevalence, especially for sex offenders. The present study aimed to confirm these findings for offenders in Switzerland. Method: Socio-demographic, psychiatric, and criminological data were collected from correctional and court files for a representative sample of violent (N = 292) and sex offenders (N = 159) in the Canton of Zurich, Switzerland. Results: The finding of the present study was that sex offenders were twice as often sexually abused than violent offenders (13% vs. 6%). The highest prevalence of sexual abuse was documented in the files of child molesters (19%). There were no significant differences between violent and sex offenders concerning other victimizing experiences. The prevalence for the complete offender population is within the range of the prevalence of sexual and physical abuse in the general population in Switzerland. Conclusion: These findings indicate that increased victimization is not a common phenomenon in offenders in general, but rather a specific attribute of sex offenders.

      Catamnestic studies of sexually abused children have found an elevated risk of adulthood offending. Studies among offenders have repeatedly reported an elevated prevalence of childhood sexual abuse (CSA), especially among sex offenders. This study aimed to examine differences between offenders with and without a history of CSA. Method: From correctional and court files socio-demographic, psychiatric, and criminological data was collected for a representative sample of violent (n = 292) and sex offenders (n = 159) in the Canton of Zurich, Switzerland. Results: Logistic regression analysis showed sexually abused offenders differed substantially from those not sexually abused. They were more likely to have grown up under a combination of distressing living conditions, to be mentally ill, and to prostitute themselves. They were also more likely to commit a sex offence, to have a pertinent criminal record (OR = 2.6) and a history of court-ordered therapy (OR = 2.6). Conclusion: The findings corroborate the association between CSA and sex offending. CSA appears to be associated with persistent offending and lack of therapy success.
